Terms of Use
These Terms of Use (“Terms”) form a binding legal agreement between you and Idicine (“Idicine,” “Company,” “we,” “us,” or “our”) governing your access to and use of the Idicine mobile application, website, software, communities, Bio Chats, matching features, content, and related services, collectively, the “Service.”
By accessing or using the Service, creating an account, uploading information, joining a Bio Chat, posting content, or otherwise using Idicine, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please read these Terms carefully. They include important disclaimers, limitations of liability, an arbitration agreement, and a class action waiver.
1. What Idicine Is
Idicine is a peer-support and community platform for self-reported health and wellness experiences.
About the entity. “Idicine” is currently registered in the Netherlands and maintains a contact address in San Francisco, California. We expect to re-incorporate as a Delaware corporation in the future; until that re-incorporation is complete, references to “Idicine” in these Terms refer to the Netherlands-registered entity, and these Terms will be updated to reflect the successor entity at the time of re-incorporation.
The Service allows users to create and join “Bio Chats,” which are user-created conversations about personal experiences such as fatigue, sleep, training, supplements, medication reactions, side effects, blood type, genetic traits, biomarkers, and other health-related topics.
A Bio Chat may be visible or joinable only to users who meet a biological match threshold with the creator of that Bio Chat.
Idicine is designed to help people compare self-reported experiences with other users who may be biologically closer to them. It is not designed to provide medical advice, diagnosis, treatment, prescriptions, clinical decisions, or emergency support.
2. What Idicine Is Not
- Idicine is not a healthcare provider.
- Idicine is not a medical device.
- Idicine is not a doctor, clinician, pharmacy, laboratory, genetic testing provider, hospital, health plan, or emergency service.
- Idicine does not provide medical advice, diagnosis, treatment, prescriptions, dosing instructions, clinical recommendations, or professional health services.
- Idicine does not recommend or endorse any medication, supplement, product, test, physician, procedure, treatment, protocol, dosage, or health decision.
- Idicine does not guarantee that any user, Bio Chat, match score, post, experience, AI-generated summary, product mention, or community signal is accurate, safe, complete, clinically valid, or applicable to you.
3. No Medical Advice
All content and features on the Service are for informational, educational, peer-support, and community purposes only.
You should always seek the advice of a physician, pharmacist, genetic counselor, or other qualified healthcare professional with any questions about your health, symptoms, medication, supplements, dosage, side effects, test results, genetic data, biomarkers, or treatment decisions.
Never disregard professional medical advice or delay seeking professional medical advice because of something you read or see on Idicine.
Never start, stop, change, increase, decrease, combine, or substitute any medication, supplement, treatment, dosage, or health routine based on the Service or based on another user's experience.
4. Emergencies
Idicine is not for emergencies.
If you think you may have a medical emergency, call 911 immediately or seek emergency medical care.
If you are in emotional distress, thinking about self-harm, or may be in danger, call or text 988 in the United States, contact emergency services, or seek immediate help from a qualified professional.
Idicine cannot monitor, respond to, or assist with emergencies.
5. Eligibility
You must be at least 18 years old to use the Service.
By using the Service, you represent and warrant that you are at least 18 years old; you have the legal capacity to enter into these Terms; you are using the Service for your own personal, non-commercial purposes; all information you provide is truthful, accurate, and not misleading; and your use of the Service complies with all applicable laws.
6. United States Focus
The Service is currently intended for users located in the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
7. Your Account
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials, all activity under your account, keeping your account information accurate, and promptly notifying us of unauthorized use or security concerns.
8. Usernames and Anonymity
Idicine may allow users to use usernames, avatars, anonymous profiles, or privacy-focused identity settings. You agree not to impersonate another person, falsely claim credentials, misrepresent your identity, or create an account intended to deceive others.
9. Bio Profiles and Bio Matching
Idicine may allow you to create a bio profile using information such as: blood type; genetic traits; biomarker signals; lab-related information; supplement experiences; medication experiences; symptoms or wellness experiences; health goals; self-reported reactions; and other profile signals.
A “bio match,” match score, or match threshold is a product feature. It is not a medical, clinical, diagnostic, genetic, scientific, or treatment determination. Bio matching is intended only to help organize peer-support conversations.
10. Bio Chats
A Bio Chat is a user-created conversation that may be visible or joinable only to users who meet a match threshold with the Bio Chat creator. By joining or participating in a Bio Chat, you understand that other users are not medical professionals acting in a professional capacity; experiences shared by users are self-reported; posts may be inaccurate, incomplete, misleading, harmful, or not applicable to you; and you participate at your own risk.
11. No Professional Relationship
Your use of Idicine does not create a doctor-patient, clinician-patient, pharmacist-patient, genetic counselor-client, therapist-client, fiduciary, advisor, or other professional relationship between you and Idicine or between you and any other user.
12. AI and Automated Features
The Service may include automated, algorithmic, AI-assisted, or machine-generated features. These features may be inaccurate, incomplete, outdated, misleading, or inappropriate for your situation. AI-generated or automated outputs are not medical advice, diagnosis, treatment, clinical decision support, safety clearance, or professional guidance.
13. Uploads, Genetic Data, Biomarkers, and Sensitive Information
The Service may allow you to enter or upload sensitive information, including blood type, lab-related information, genetic information, biomarker information, medication experiences, supplement experiences, symptoms, or other health-related information. You should only provide information that you are comfortable submitting to the Service.
14. Consent and Privacy Settings
Certain features may require specific consent, including consent to use genetic or biomarker information for matching, Bio Chat access, analytics, research, or other purposes described in the Privacy Policy.
15. User Content
“User Content” means any content you submit, post, upload, create, transmit, or make available through the Service. You retain ownership of your User Content, subject to the rights you grant us in these Terms. You are solely responsible for your User Content.
16. License to User Content
By submitting User Content, you grant Idicine a worldwide, non-exclusive, royalty-free license to host, store, use, reproduce, modify, adapt, publish, translate, distribute, perform, and display your User Content solely for the purposes of operating, maintaining, and improving the Service. This license does not permit Idicine to sell, transfer, or sublicense your User Content to third parties for their independent use.
17. Aggregated and De-Identified Information
To the extent permitted by law, we may use information that has been aggregated, de-identified, anonymized, or otherwise processed so it no longer reasonably identifies you.
18. Research, Studies, and Third-Party Projects
We may offer opportunities to participate in research, studies, surveys, product tests, clinical trial awareness, or third-party projects. Participation will be optional unless otherwise stated.
19. Affiliate Links, Products, and Third-Party Offers
The Service may display or link to third-party products, supplements, services, apps, tests, providers, retailers, or offers. Some links may be affiliate links, meaning Idicine may receive compensation if you click a link or purchase a product. Product mentions, affiliate links, community mentions, and user experiences are not medical advice.
20. Subscriptions, Fees, and Purchases
The Service may be free or may offer paid features. If paid features are offered, prices, billing terms, renewal terms, cancellation terms, and refund policies will be presented at the time of purchase. Unless otherwise required by law or stated at purchase, payments are non-refundable.
21. Apple App Store Terms
If you download or use the Service through the Apple App Store: These Terms are between you and Idicine, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
22. Acceptable Use
You agree not to use the Service to provide or request emergency medical help; provide medical advice as a substitute for professional care; tell another user to start, stop, change, increase, decrease, combine, or substitute medication, dosage, supplements, or treatment; claim to diagnose, treat, cure, or prevent disease; make false, misleading, or unsubstantiated health claims; promote dangerous health practices; harass, threaten, abuse, stalk, bully, or intimidate others; post hateful, discriminatory, obscene, sexually explicit, violent, or exploitative content; impersonate another person or misrepresent credentials; scrape, harvest, mine, or collect user data; use bots, crawlers, scrapers, or automated tools without permission; reverse engineer, decompile, or attempt to extract source code; interfere with, disrupt, overload, or attack the Service; circumvent security, access controls, match thresholds, paywalls, or privacy settings; violate any law, regulation, contract, or third-party right; or upload, submit, or use health, genetic, biomarker, or personal information belonging to another person without legal authority to do so and without all required consents from that person.
23. Health and Safety Moderation
We may moderate, remove, restrict, label, downrank, hide, or report content that we believe violates these Terms, creates health or safety risk, misleads users, harms trust, violates privacy, or may expose Idicine or users to legal risk.
24. Community Rules
You agree to treat other users with respect. You may share your personal experience, but you may not present your experience as medical advice or as guaranteed to apply to others.
You may say: “This happened to me.” “I experienced this.” “I discussed this with my clinician.” “This is what I noticed.”
You may not say: “You should take this.” “Stop your medication.” “This cures it.” “This is safe for your genes.” “This dose will work.” “Doctors are wrong, do this instead.”
25. Reporting Violations
You may report content or users that you believe violate these Terms. We may investigate reports at our discretion. If you believe someone is in immediate danger, contact emergency services. Do not rely on Idicine.
26. Commercial Use
The Service is for personal, non-commercial use unless we expressly authorize otherwise in writing.
27. Healthcare Professionals, Researchers, Brands, and Organizations
Healthcare professionals, researchers, supplement brands, pharmaceutical companies, wellness companies, agencies, nonprofits, employers, insurers, and other organizations may not use the Service for professional, commercial, research, recruitment, advertising, surveillance, or organizational purposes without our express written permission.
Violation of this section constitutes a material breach of these Terms and may result in immediate account termination without notice or refund.
28. User Privacy and Other Users
You agree not to disclose, copy, screenshot, export, publish, identify, re-identify, or otherwise share another user's personal, health, genetic, biomarker, or sensitive information outside the Service without that user's explicit consent.
29. Intellectual Property
The Service, including its software, designs, features, interfaces, graphics, trademarks, logos, content, compilation, organization, and technology, is owned by Idicine or its licensors and is protected by intellectual property laws.
30. Feedback
If you send us ideas, suggestions, feedback, or proposals, you grant us a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free license to use them without restriction or compensation to you.
31. Third-Party Services
The Service may contain links, integrations, content, products, services, or features provided by third parties. We do not control and are not responsible for third-party services.
32. Availability and Changes to the Service
We may modify, suspend, discontinue, replace, or remove any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available, uninterrupted, secure, error-free, or compatible with your device or expectations.
33. Beta Features
Some features may be experimental, beta, preview, limited release, or under development. Beta features may be incomplete, inaccurate, unstable, discontinued, or changed without notice. You use beta features at your own risk.
34. Termination
You may stop using the Service at any time. We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice. Upon termination, your right to use the Service stops immediately.
35. Account Deletion
You may request deletion of your account through the Service or by contacting us at support@idicine.com. Deletion requests will be handled as described in our Privacy Policy and applicable law.
36. Privacy Policy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using the Service, you agree to our Privacy Policy.
37. No HIPAA Representation
Unless we expressly state otherwise in a separate written agreement, Idicine is not providing the Service on behalf of a healthcare provider, health plan, healthcare clearinghouse, or other HIPAA covered entity. We do not represent that the Service is HIPAA-compliant unless expressly stated in a separate written agreement signed by Idicine.
38. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDICINE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
YOU USE THE SERVICE AT YOUR OWN RISK.
39. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDICINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDICINE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: THE AMOUNT YOU PAID TO IDICINE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE; OR 100 U.S. DOLLARS.
Nothing in this section limits Idicine's liability for gross negligence, willful misconduct, fraud, or claims that cannot be limited or excluded under applicable law, including claims under state consumer health data laws.
Notwithstanding the foregoing, nothing in this section limits, waives, or excludes any rights or remedies that cannot be waived or limited under applicable law, including but not limited to: (a) statutory damages under the California Confidentiality of Medical Information Act (Cal. Civ. Code § 56 et seq.); (b) statutory damages under the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq.); (c) remedies available under the Washington My Health My Data Act (RCW 19.373); and (d) any other non-waivable statutory rights under applicable state or federal law. The $100 limitation does not apply to any claim arising under a statute that expressly prohibits limitation of remedies.
40. Indemnification
You agree to defend, indemnify, and hold harmless Idicine and its officers, directors, employees, contractors, affiliates, agents, licensors, service providers, and partners from and against any claims, liabilities, damages, losses, costs, and expenses arising from or related to: your use of the Service; your User Content; your violation of these Terms; your violation of law; or your violation of another person's rights.
41. Release
To the maximum extent permitted by law, you release Idicine from claims, demands, liabilities, damages, and losses arising from: user-generated content; interactions with other users; third-party products or services; health decisions; medical outcomes; match scores; Bio Chats; or reliance on information found through the Service.
If you are a California resident, you waive California Civil Code Section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You expressly waive this provision to the fullest extent permitted by law.
This release does not apply to any non-waivable statutory rights, including rights under California Civil Code § 56 (CMIA), California Civil Code § 1798.192 (CCPA anti-waiver), or the Washington My Health My Data Act.
42. Dispute Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@idicine.com. We will try to resolve the dispute informally within 30 days.
43. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for claims that qualify for small claims court or claims for injunctive relief related to intellectual property or unauthorized access, you and Idicine agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules.
You and Idicine waive the right to participate in a class action, class arbitration, collective action, representative action, private attorney general action, or consolidated proceeding to the maximum extent permitted by law.
To the extent any claim under the California Genetic Information Privacy Act, Washington My Health My Data Act, or similar applicable state consumer health data law cannot by law be subject to binding arbitration or class action waiver, such claims are excluded from this arbitration agreement and class action waiver and may be brought in a court of competent jurisdiction.
44. Arbitration Opt-Out
YOUR RIGHT TO OPT OUT: You have the right to opt out of the arbitration agreement described in Section 43. To exercise this right, you must send written notice within 30 days of first accepting these Terms. Instructions are below.
You may opt out of the arbitration agreement by sending written notice to legal@idicine.com within 30 days after you first accept these Terms. Your opt-out notice must include your name, email address associated with your account, and a clear statement that you opt out of arbitration.
45. Governing Law
Because Idicine is currently registered in the Netherlands (see Section 1), these Terms and any dispute arising from or related to these Terms or the Service are governed by the laws of the Netherlands, without regard to conflict of law rules, except that:
(a) the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the arbitration agreement in Section 43;
(b) your non-waivable rights under applicable U.S. state consumer privacy and health-data laws — including the California Confidentiality of Medical Information Act (Cal. Civ. Code § 56 et seq.), the California Consumer Privacy Act / California Privacy Rights Act (Cal. Civ. Code § 1798.100 et seq.), the California Genetic Information Privacy Act, the Washington My Health My Data Act (RCW 19.373), Nevada SB 370, Connecticut SB 3, and the Colorado Privacy Act — continue to apply regardless of this choice of law and may be enforced in U.S. courts as required by those laws; and
(c) if and when Idicine re-incorporates in another jurisdiction (such as the State of Delaware), these Terms will be updated to reflect the new governing law, and your continued use of the Service after the update will constitute agreement to the change.
46. Copyright Complaints
If you believe that content on the Service infringes your copyright, you may send a written notice to our copyright contact. Your notice must include:
(1) A physical or electronic signature of the copyright owner or authorized agent;
(2) Identification of the copyrighted work claimed to have been infringed;
(3) Identification of the material claimed to be infringing, with enough detail for us to locate it on the Service;
(4) Your contact information, including name, address, telephone number, and email address;
(5) A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
(6) A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We will review valid notices and may remove or restrict access to material we determine is infringing. Repeat infringers may have their accounts terminated.
Idicine has not yet registered a designated agent with the U.S. Copyright Office under 17 U.S.C. § 512(c)(2), and accordingly does not represent that the Service currently qualifies for the DMCA safe harbor. We expect to complete that registration as part of our re-incorporation in the United States. Notwithstanding the foregoing, you may submit a counter-notice to copyright@idicine.com if you believe your content was removed in error, and we will consider the counter-notice in good faith.
47. Communications
You agree that we may send you service-related notices by email, in-app message, push notification, or other reasonable means.
48. Mobile Messages and Push Notifications
If you enable push notifications, you consent to receive notifications related to your account, Bio Chats, matches, replies, product updates, safety notices, or other Service features. You can disable push notifications through your device settings.
49. Export Controls and Sanctions
You represent and warrant that you are not located in a country subject to a U.S. government embargo or sanctions and are not on any U.S. government list of prohibited or restricted parties.
50. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.
51. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
52. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
53. Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
54. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms that apply to specific features, are the entire agreement between you and Idicine regarding the Service.
